Robotaxi Accident Lawsuits: Claims Involving Driverless Ride-Hail Vehicles

Status: Investigating claims · Last updated November 2026

If you were hit by a driverless robotaxi, or injured while riding in one, you may have a claim against the company that operates it. Robotaxis now carry paying passengers in a growing number of U.S. cities. When there is no human driver, responsibility for a crash shifts to the company that built and runs the system.

At Wieand Parker Arreola, we are investigating injuries involving driverless ride-hail vehicles, also called autonomous vehicles or robotaxis. This page explains how these cases differ from ordinary car accidents, what regulators are examining and who may qualify. Call (215) 666-7777 for a free, confidential case review.

How Robotaxis Work and Where They Operate

A robotaxi uses cameras, radar, lidar and software to drive itself with no one behind the wheel. Remote staff may monitor the fleet, but the vehicle makes driving decisions on its own. Companies leading the industry include Waymo, Zoox and Tesla, and ride-hail apps such as Uber and Lyft have partnered with autonomous vehicle developers. Service is expanding quickly. In Pennsylvania, Act 130 of 2022 allows driverless vehicles on public roads, with PennDOT as the sole regulator, and PennDOT adopted guidelines for fully driverless operation in October 2024. Learn more on PennDOT’s automated vehicles page.

These are different from driver-assist systems, where a human must stay in control. For crashes involving those systems, see our Tesla Autopilot and Full Self-Driving lawsuit page.

    What Regulators Are Examining

Federal safety regulators have opened a series of investigations into driverless vehicles:

    • In January 2026, a Waymo vehicle struck a child near an elementary school in Santa Monica, California. The child suffered minor injuries. The National Highway Traffic Safety Administration (NHTSA) and the National Transportation Safety Board both opened investigations focused on behavior in school zones.
    • NHTSA had already opened a probe in late 2025 into reports of Waymo vehicles passing stopped school buses, which led to a voluntary software recall.
    • In October 2023 in San Francisco, a pedestrian was hit by a human driver and thrown into the path of a driverless Cruise vehicle. The vehicle then dragged her about 20 feet. In 2024, Cruise, then GM’s robotaxi unit, agreed to a $1.5 million NHTSA penalty for crash reports that left out the dragging.

These actions show the kinds of failures that can support injury claims.

    Who Can Be Held Responsible

With no human driver, the usual defendant changes. Claims may be brought against:

    • The robotaxi operator, for negligent operation, monitoring and maintenance of its fleet
    • The developer of the self-driving system, under product liability law for design defects and failure to warn
    • A ride-hail platform that dispatched the vehicle, depending on its role
    • Other drivers who contributed to the crash

Robotaxis record extensive video and sensor data. That evidence can show exactly what the vehicle saw and how it responded, but it is controlled by the company, so acting quickly matters. Learn more about our general self-driving vehicle accident and rideshare accident practices.

Who May Qualify for a Robotaxi Accident Claim

These are the main factors we review:

    1. Your role. Passengers, pedestrians, cyclists and occupants of other vehicles may all have claims.
    2. Injuries. Any injury requiring medical care, especially fractures, head injuries or wrongful death.
    3. The vehicle. The company, trip details or vehicle number, from your app receipt or photos.
    4. Evidence. Police reports, photos, witnesses and your own phone video.
    5. Prompt action. Filing deadlines apply, so contact a lawyer promptly to protect your rights.

What to Do After a Robotaxi Crash

Get medical care first. Then photograph the vehicle, including any number on it, and the scene. Save your trip receipt and in-app messages. Report the crash to police. Be careful with in-app surveys or offers from the company, and talk to a lawyer before signing anything.

    Robotaxi Accident Lawsuit FAQs

Who pays if no one was driving?

Usually the operator or developer of the driverless system, along with any other at-fault party.

Did I give up my rights in the app’s terms?

Not necessarily. App terms may include arbitration clauses, and whether they apply to an injury depends on the facts. A lawyer can review them.

Are robotaxis safer than human drivers?

Companies say so. But every crash involves its own facts, and a company is responsible when its system fails.
