Gambling App Addiction Lawsuits: Sports Betting and Online Casino Claims

Status: Investigating claims · Last updated November 2026

If you or a family member developed a gambling addiction through sports betting or online casino apps and suffered devastating losses, you may have a claim against the companies that designed and marketed those apps. Several new lawsuits filed in Pennsylvania argue that betting apps are built to hook users and target people who are already struggling.

At Wieand Parker Arreola, we are investigating gambling app addiction claims involving sports betting, online casino and similar wagering apps. This page explains what the lawsuits allege, where they stand and who may qualify. Call (215) 666-7777 for a free, confidential case review.

How Betting Apps Are Designed to Keep You Playing

Sports betting became legal in Pennsylvania in 2018, and betting moved from casinos onto phones. The lawsuits allege that app makers use data and behavioral design to increase wagering, including:

    • In-game “microbetting” on the next play or pitch, which resolves in seconds, much like a slot machine
    • VIP hosts who offer bonuses, game tickets and perks to the heaviest bettors
    • Personalized promotions triggered when a user tries to slow down or stop
    • Constant notifications and bonus credits that encourage bets around the clock
    • Weak responsible-gaming tools that are hard to find or easy to override

Lawsuits point to research showing a small share of problem gamblers can account for a large share of sports betting revenue.

    Gambling App Lawsuit Update

In March 2026, two Pennsylvania men filed a product liability suit in Philadelphia against DraftKings, FanDuel, data provider Genius Sports and the NFL. They allege online sports betting is an unreasonably dangerous product designed to encourage compulsive use. One plaintiff claims losses of more than $1.5 million. In August 2026, a Pittsburgh man sued FanDuel in the Allegheny County Court of Common Pleas, alleging the app’s design is dangerously addictive.

These cases face real legal hurdles. In March 2026, a federal judge in Pennsylvania dismissed a separate proposed class action against DraftKings, ruling that the company had no legal duty to protect bettors from gambling addiction. That case is on appeal to the Third Circuit. The newer suits rely on different theories that treat the apps themselves as defective products. Courts have not yet decided whether those theories will succeed.

These claims follow the same design-defect approach used in social media addiction lawsuits and video game addiction lawsuits.

Who May Qualify for a Gambling App Lawsuit

These are the main factors we review:

    1. Heavy app-based wagering on sports betting, online casino or similar apps.
    2. A diagnosis or treatment. Gambling disorder, counseling, inpatient treatment or support-group participation.
    3. Serious losses. Large financial losses, debt, job loss, family breakdown or related mental health harm.
    4. Company conduct. VIP host contact, bonuses or promotions offered while you were losing heavily or after you tried to stop.
    5. Minors. Anyone who gambled on these apps while under 21, the legal age in Pennsylvania.
    6. Prompt action. Filing deadlines apply, so contact a lawyer promptly to protect your rights.

    Preserving the Evidence

Download your full account and transaction history from each app before closing accounts. Save emails, texts and app messages from VIP hosts or promotions, along with bank and credit card statements and any treatment records.

    Gambling App Lawsuit FAQs

    Isn’t gambling a personal choice?

The lawsuits argue that these apps are engineered to override that choice, especially for people prone to addiction. Your own decisions will be considered, but they do not automatically bar a claim.

Can I get my losses back?

Depending on the claim, damages may include financial losses, treatment costs and other harm. Every case is different.

I self-excluded but kept getting offers. Does that matter?

Yes. Offers or access after self-exclusion can be important evidence.
