Video Game Addiction Lawsuits: Fortnite, Roblox, Minecraft and Call of Duty Claims

Status: Investigating claims · Last updated November 2026

If your child became addicted to video games and suffered depression, anxiety, school failure, physical health problems or other serious harm, your family may have a claim against the companies that designed those games. More than 100 lawsuits now allege that major game makers deliberately built their products to keep children playing and spending.

At Wieand Parker Arreola, we are investigating video game addiction claims involving Fortnite, Roblox, Minecraft, Call of Duty and other popular games. This page explains what the lawsuits allege, where they stand and who may qualify. Call (215) 666-7777 for a free, confidential case review.

How Games Are Designed to Keep Kids Playing

The lawsuits allege game companies used behavioral psychology to encourage compulsive play and spending, including:

    • Variable rewards and loot boxes that work like slot machines
    • Battle passes, daily rewards and limited-time events that punish breaks
    • In-game currencies that hide how much real money is being spent
    • Social pressure to keep up with friends and buy cosmetic items
    • No meaningful warnings to parents about addiction risks

The World Health Organization recognizes “gaming disorder” as a medical condition. Plaintiffs argue that game makers knew children were especially vulnerable and designed around that vulnerability.

    Video Game Addiction Lawsuit Update

In California, more than 100 cases are coordinated in a state court proceeding in Los Angeles, known as JCCP 5363. Defendants include Roblox, Epic Games (Fortnite), Microsoft and its studio Mojang (Minecraft) and Activision (Call of Duty). No trial date had been set as of fall 2026, and no company has paid a settlement tied specifically to addiction claims.

In federal court, the cases remain spread across districts. In late 2025, the Judicial Panel on Multidistrict Litigation declined a request to centralize dozens of video game addiction suits in federal court in Philadelphia. In Pennsylvania’s federal courts, the companies have had mixed success forcing these cases into private arbitration. One judge sent a case to arbitration in May 2026, while another refused to in September 2026.

These cases follow the path of the social media addiction lawsuits, which produced the first jury verdict against Meta and YouTube in March 2026.

    The Legal Claims

Families are bringing claims for defective design, failure to warn, negligence and deceptive practices. Some also seek refunds of money spent on in-game purchases by minors.

Who May Qualify for a Video Game Addiction Lawsuit

These are the main factors we review:

    1. Play that began as a minor. Heavy, compulsive play of one or more popular games before age 18.
    2. A diagnosis or treatment. Gaming disorder, depression, anxiety or a related diagnosis, or therapy, residential treatment or hospitalization.
    3. Real-world harm. Falling grades, dropping out, sleep loss, weight changes, withdrawal from family or aggression when play is limited.
    4. Spending. Significant in-game purchases, especially without parental knowledge.
    5. Filing deadlines. Rules for minors vary by state, so speak with a lawyer promptly.

    Preserving the Evidence

Keep the gaming accounts active and download account data where available. Save purchase receipts, bank or card statements, school records and treatment records. Console and app screen-time reports can show how much time was spent playing.

    Video Game Addiction Lawsuit FAQs

    Which games are involved?

Lawsuits most often name Fortnite, Roblox, Minecraft and Call of Duty, but claims may involve other games with similar design features.

Did my child’s account terms waive the right to sue?

Not necessarily. Courts have reached different results on arbitration clauses involving minors. A lawyer can review the specific terms.

Is this the same as the Roblox exploitation cases?

No. Addiction claims are separate from claims that predators used Roblox to reach children. See our Roblox lawsuit page.
